An 18-year-old in Florida was arrested for the alleged rape of a 15-year-old girl that was overheard by another video game player at the time, according to CBS 12.
They say Daniel Enrique Fabian is charged with lewd and lascivious battery for the incident that happened in June at his home.
Our source says the witness was playing Grand Theft Auto with Fabian when Fabian said he was going to “smash” a girl at his home.
According to the affidavit, Fabian left the game for about 15 minutes and kept his gaming microphone on. The witness could hear groaning and moaning, followed by the victim saying “no.”
The affidavit says Fabian continued to have sex with her even she after told him to stop four separate times.
Fabian then began to to play the video game again.
Authorities say the 15-year-old victim completed a Sexual Assault Victim Exam (SAVE) that supported her claims. A DNA evaluation matched samples from the victim and the suspect.
He is currently being held at a detention center in Florida.
